Power Generation Theory and Failures will be presented by Arthur I. Carlisle, CEng, MIMechE, London District Manager with Rimkus Consulting Limited. During the two-day training session, Mr. Carlisle will present a series of six lectures which will include power generation theory, types and application of equipment, and case studies on failures. Mr. Carlisle’s more than 25 years’ experience includes all aspects of project development including conceptual engineering and costing, contracting, engineering design, procurement, construction, startup and testing, and placement into commercial operation.

ABA Environmental, Mass Torts, & Products Liability Seminar
January 30, 2015 - Snowmass Village, CO
Fracked Up: A Case Study on the Interaction of Layered Fracking Laws and Regulations in Different States will address legal issues that are constantly arising due to hydraulic fracturing. During the past few years, operators have had to deal with new fracking fluid disclosure requirements as well as conflicting local and state regulations of their drilling practices. This panel will present a case study in a locality in which an operator is faced with allegations of suspected contamination and faces tort and regulatory consequences. Further, the panel will discuss the various environmental, regulatory, and mass tort issues that may arise, and also discuss how the analysis would change if the accident occurred in another state and in another regulatory climate.

The Expert’s Perspective on Premises Liability Claimswill be presented by Richard V. Baratta, PhD, PE, Vice President with the Rimkus Biomechanical Practice Group, and Christopher R. Grubbs, PE, LEED® AP, CXLT, Rimkus District Manager. The presentation will focus on the engineering expert’s role in managing premise liability claims within the hospitality industry. Utilizing case studies to illustrate the issues, Dr. Baratta and Mr. Grubbs will present on premise design, construction, and maintenance, as well as human motion, perception-reaction, and injury mechanics. Dr. Baratta’s engineering, research, and consulting background encompasses biomedical analysis of incidents involving low-speed vehicle accidents, pedestrian accidents, slip and falls, falling objects, and related events. Mr. Grubbs offers a diverse background in all phases of planning, surveying, design, and construction. In addition, he has extensive experience with site and building layout design with respect to pedestrian and traffic flow, parking lot designs, accessibility, building code compliance, as well as slip, trip, and fall avoidance.
Legionellosis will be presented by Jeffrey H. Peters, PE, LEED® AP BD+C, MAC, CEICC, CSDS, CMCC, Vice President with the Rimkus MEP Practice Group. One organism occasionally evades our best efforts at water treatment - the Legionella bacterium. Exposure to elevated amounts of Legionella in susceptible individuals can potentially cause them to contract Legionnaires Disease (LD), a potentially life threatening illness. Mr. Peters will present on the standard of care to be considered in minimizing exposure to the Legionella bacterium, and how best to respond to an exposure allegation. Mr. Peters has more than 30 years of diversified building science, engineering design, facility management, and forensic consulting experience. His expertise includes the origin and cause analysis of claims involving indoor air quality, fungal contamination, Legionella, Spray Polyurethane Foam (SPF), carbon monoxide, soot, and water/vapor intrusion through building envelopes, among other issues.

Liquor, Low Light Scenarios, and the Visible Intoxication Standard will present a fact scenario examining various liquor liability scenarios within a strip club. The “visible intoxication” standard will be explored, and panelists will discuss plaintiffs’ use of expert testimony to attempt to prove visible intoxication even in the absence of direct testimony on the issue, and the possible use of such testimony by the defense to refute law testimony of visible intoxication based on expert analysis of actual alcohol consumption and blood alcohol levels. The impact of “low light” situations on the visible intoxication standard will also be discussed.
